Nevada is an at-fault state, so the driver who causes a crash is responsible for the resulting damages. You can still recover compensation as long as your share of fault is not greater than the other party’s, and your recovery is reduced by your percentage of fault.

Nevada’s minimum liability coverage is 25/50/20 under NRS 485.185: $25,000 in bodily injury per person, $50,000 per accident, and $20,000 for property damage. Those limits are low. A single hospital stay can burn through a 25/50/20 policy on its own, and then you’re facing the remainder yourself unless there’s another source of recovery. The at-fault driver may also carry no insurance at all, which is not rare here.

Many people don’t realize they may already be covered for this. Under NRS 690B.020, every insurer in Nevada has to offer uninsured and underinsured motorist coverage, and you can only decline it in writing.
